Official Rules and Regulations
1. Purchase of Three Course Regional Menu is necessary to enter or win.
2. Eligibility
Open to legal residents of the United States, 18 years or older who purchase the Regional Menu during the duration of the program as described in Section 6 below. Employees, officers, and directors of Pacific Catch, along with its affiliated entities, subsidiaries, advertising, promotion and fulfillment agencies, legal advisors, their immediate family members and persons living in their same household, are not eligible to participate or receive prizes. Void wherever restricted, taxed or prohibited by law.
Program available at both the 9th Ave and Corte Madera locations.
3. Pacific Catch "Explore the Tastes of the Pacific and End up in Hawaii" Prize will be as follows:
One trip for two persons to Hawaii, including roundtrip coach airfare from San Francisco (SFO) or Oakland (OAK) Airport to Honolulu Hawaii (HNL); seven nights lodging in standard, double occupancy room in the Honolulu, HI vicinity.
The maximum value of the Grand Prize is approximately $3,000.00. Some date restrictions will apply to all prizes and the dates will be subject to availability. The winner is required to confirm a suggested departure date 45 days prior to departure.
Because the winners will be selected by random drawing from the pool of all eligible entries, the odds of winning will depend upon the number of eligible entries received.
4. Program Duration
The full term of the program is as follows: May 5, 2008 through November 23, 2008.
5. Prize Drawing
The Grand Prize drawing will be held at the Pacific Catch corporate offices Monday December 1st. The winner will be selected in a random drawing from among all entries received for the grand prize drawing.
6. To enter:
- Dine at Pacific Catch 9th Ave or Corte Madera location during dinner starting at 4:00 pm until locations close time.
- Choose the featured Regional Menu being offered and receive entry to the Grand Prize raffle.
- Completely fill out the entry card presented with your final check and return to your server at time of bill reconciliation. You must include your name, phone number, address and email address on the entry form for it to be completed and eligible. The entry must be filled out at time of payment.
7. Notification of Winners
Pacific Catch will notify winners by phone. Pacific Catch is not responsible for any late, lost, or misdirected notification. E-mail notifications do not constitute a guarantee of payment of any kind. Pacific Catch will verify the eligibility of the winners prior to awarding any prize. Prizes may not be transferred or substituted, except that Pacific Catch may substitute prizes of equal or greater value at its sole discretion.
In the event a winner does not or cannot accept any prize for any reason within seven (7) days after being notified by Pacific Catch by phone that he/she is the winner, his/her prize will be forfeited.
Winners will be required to agree (in writing) to an Affidavit of Eligibility and to provide their full name, address, city, state, postal code, and date of birth, and, where lawful, a Liability and Publicity Release within seven (7) days of notification, or the winner's prize may be forfeited. All information and related tickets for the Prizes will be mailed within sixty (60) days after receipt of the completed Affidavit of Eligibility by Pacific Catch and, where applicable, the Liability and Publicity Release. All prizes must be used or travel commenced by the winners within twelve (12) months following receipt of the Prize information. All federal, state, provincial and/or local taxes/duties are the sole responsibility of the winner. By accepting the Prize and executing the Liability and Publicity Release, each winner agrees that Pacific Catch may post the winner's name on a list of winners, and may use the winner's name, voice, likeness, biographical information, winning entry and statements accurately attributed to the winner for the purpose of advertising, trade, or promotion purposes without further notification or compensation.
8. Obtaining a list of winners
The winner of the Grand Prize will be announced at the Regional Program "Members Only" party at Pacific Catch 9th Ave on December 3rd. The event date may change at the discretion of Pacific Catch.
9. Limitation of Liability and Release
Pacific Catch, its subsidiaries and affiliated companies, agents, officers, directors and representatives are not responsible for: (i) any condition caused by events beyond their control that may cause the Sweepstakes, the entry process, or the website to be disrupted or corrupted; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of any prize, or acceptance, possession, or use or misuse of any prize, or from participation in or any travel resulting from the Sweepstakes; or (iii) any printing or typographical errors in any materials associated with the Sweepstakes or the entry process.
By participating in the Sweepstakes, each participant agrees that said parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, condition or fitness for a particular purpose.
By participating in the Sweepstakes, each participant agrees to release and hold Pacific Catch, its subsidiaries and affiliated companies, and the employees, officers, directors, shareholders, agents, representatives of Pacific Catch, its affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind (including attorney's fees and costs) in connection with the Sweepstakes, the entry process, or resulting from acceptance, possession, or use or misuse of any prize, including, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.
10. General Terms and Conditions
Pacific Catch may terminate and permanently disqualify any entrants in the prize drawing who Pacific Catch, in its sole discretion, determines as being in violation of these Official Rules. If Pacific Catch terminates an account and/or disqualifies an entrant, the entrant will immediately lose any right of access to any prizes associated with his or her account. All decisions by Pacific Catch are final.
Pacific Catch, its subsidiaries, and affiliated companies, agents, officers, directors and representatives are not responsible for any error, omission, interruption, deletion, defect, or delay in operations or transmission; theft or destruction or unauthorized access or alterations of entry materials, computer transmissions, or for technical telephone equipment, electronic, hardware or software, network, Internet, or computer malfunctions of any kind; or inaccurate transmission of, or failure to receive entry information by Pacific Catch on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof.
If technical or other difficulties compromise the integrity or ability to continue online registration or cause the Sweepstakes or the Web site to be corrupted or disrupted, Pacific Catch reserves the right in its sole discretion to terminate or suspend the Sweepstakes prior to the date by which all registrations must be received. By participating in the Sweepstakes, the entrants agree to be bound by the Official Rules. These rules will be interpreted in the sole discretion of Pacific Catch, and all determinations made pursuant to these rules by Pacific Catch are final and binding. Information obtained on entry cards will not be sold to any other company.
Entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with this contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California or the appropriate California State Court located in Marin County, California, U.S.A. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant or Pacific Catch in connection with the contest, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
All entries become the exclusive property of Pacific Catch and as such, Pacific Catch has the right to edit, adapt, modify, publish, promote and otherwise use or not use the entries and the information contained therein in any way it sees fit. Entries will not be returned. All federal, state, provincial and local laws and regulations apply.
